Las nuevas dispocisiones legislativas se refieren al tratamiento de menores delincuentes y los dispositivos resultantes que constituyen una ruptura y una regresión en la historia que comienza en 1945 con los aportes teóricos de las ciencias humanas y la experiencia profesional acumulada por los intervinientes sobre el terreno.
El modo de intervención de la protección juridica de la juventud aplicada con los adolescentes delincuentes encarcelados, nos ilustra bién esta ruptura y regresión. El educador en medio abierto y por su intermadiario la institución de la protección jurídica de la juventud debe ocupar una posición compleja de tiercidad y exterioridad a la institución penitenciaria. Continuidad de la acción educativa y exterioridad del posicionamiento institucional son inseparables y condicionan la validez de esta intervención. El retorno a la noción de re-educación opuesta a la inquietud por la consideración del sujeto y de su realidad psíquica, su colorario de retorno de la protección jurídica de la juventud,como cogerente del universo carceral para los menores invalidaran ese pocisionamiento, que busca ocuparse de la dimensión psíquica y sus potencialidades.

Jean-Marc Dupuy : the intervention of the youth worker from Judicial Youth Protection with the incarcerated minor in an open institution.
New legislation dealing with the treatment of delinquent minors and the resulting arrangements constitute a break and a regression in relation to the history of this treatment since 1945, with the theoretical contribution of the human sciences on this subject, and with the professional experience accumulated by those who intervene in this field.
The mode of intervention by Judicial Youth Protection which has now been established for dealing with incarcerated minors provides a good illustration of this regression. In an open institution, the youth worker and, through him, Judicial Youth Protection, must occupy a complex position as a third party outside the penal institution. The continuity of the educative action and the exteriority of the institutional position are inseparable and determine the validity of this intervention. The return of the notion of rehabilitation, as opposed to the concern for the consideration of the subject in his psychical reality, and its corollary, the return of the Judicial Youth Protection as co-guarantor of the penal world for minors, will invalidate this position and its potential.

Le mode d’intervention de la Protection Judiciaire de la Jeunesse mis en place auprès des mineurs incarcérés illustre bien cette rupture et cette régression. L’éducateur en milieu ouvert et, à travers lui, l’institution Protection Judiciaire de la Jeunesse, doit y occuper une position complexe de tiers extérieur à l’institution pénitentiaire. Continuité de l’action éducative et extériorité du positionnement institutionnel sont inséparables et conditionnent la validité de cette intervention. Le retour de la notion de rééducation en opposition avec le souci de la prise en compte du sujet dans sa réalité psychique, son corollaire le retour de la Protection Judiciaire de la Jeunesse comme co-gérante de l’univers carcéral pour les mineurs, vont invalider ce positionnement et ses potentialités.
